Privacy Policy
This Confidentiality and Non-Disclosure Protocol (hereinafter referred to as the “Protocol”) governs the rules regarding the content produced by the Developer mentioned below, and the content cannot be accessed unless this Protocol is accepted. As the principles stipulated by this Protocol will be deemed accepted and committed upon its signature, it must be read carefully.
In order to access the content produced by the Developer, it is necessary to fill out the registration form and accept and commit to the terms of this Protocol. Users who wish to approve this Protocol must check the option “I have read and accept the Protocol” located below the registration form. After this process, the Protocol will be considered signed by the User and will enter into force immediately.
1. Parties
This Protocol is entered into by and between TONAJ FİLM PRODÜKSİYON YAPIM SANAYİ VE TİCARET A.Ş., located at Firuzağa Mah. Çukur Cuma Cad. No: 9 İç Kapı No: 1 Beyoğlu, Istanbul (hereinafter referred to as the “Developer”) and the User who signs this Protocol and gains access to the content developed by the Developer, specifically the content named “Elementis,” as well as other future content that may be developed and made available by the Developer (hereinafter referred to as the “User”).
2. Subject of the Protocol
The subject of this Protocol is the access and usage terms regarding the content produced by the Developer.
3. Rights and Obligations of the Parties
Under this Protocol:
– The User will protect all information, whether recorded electronically or otherwise, regarding the content produced by the Developer and accessed by the User after the signing of this Protocol. This includes but is not limited to analyses, compilations, studies, proprietary information, intellectual and industrial property rights, trademarks, trade secrets, software-related information, codes, design, technical details related to computer games, and any tangible or intangible materials obtained by the User (collectively referred to as “Confidential Information”). The User shall not disclose or use this information for their own benefit.
– The User accepts, declares, and undertakes that they will not claim any rights in the testing of content, reporting of any technical issues, or corrections provided to the Developer.
– The User agrees to comply with all applicable laws and regulations when accessing the content subject to this Protocol and undertakes not to violate these provisions. Otherwise, the User shall be solely responsible for all legal, financial, and criminal liabilities arising from such violations.
– The User agrees, declares, and undertakes in advance that the personal and other information they provide while accessing the content is accurate and that they will fully compensate the Developer for any damages incurred due to false information.
– The Developer reserves the right to update, change, or revoke the terms of this Protocol at any time without prior notice or warning. Any updated, amended, or revoked provisions will become effective for the User from the date of publication.
– The User who violates this Protocol, even partially, accepts, declares, and undertakes that they will be responsible for all damages caused and will indemnify the Developer for any resulting losses, claims, lawsuits, or demands.
4. Legal Recourse
In the event of a breach of the provisions of this Protocol by the User, the Developer has the right to claim compensation equal to the damages incurred.
The User acknowledges that monetary compensation may not be sufficient if they fail to comply with their obligations under this Protocol or if the Protocol is violated by persons under their responsibility. In case of any violation or threat of violation, the Developer will have the right, in addition to its other rights and obligations under this Protocol, to seek an injunction from the court.
5. Term
This Protocol enters into force immediately upon signature, as specified in the “Introductory Provisions” section, and remains in effect indefinitely regarding the protection of Confidential Information, even if the relationship between the Parties is terminated. The User agrees, declares, and undertakes that they will not disclose or use Confidential Information and will keep it confidential.
6. Governing Law and Jurisdiction
All matters related to the validity, interpretation, enforcement, or termination of this Protocol, as well as any disputes arising between the Parties, will be governed by and interpreted in accordance with the laws of the Republic of Turkey.
In the event of any dispute, claim, or conflict arising from or related to this Protocol, including any tort or other disputes related to the Protocol, the courts and enforcement offices of Istanbul will have exclusive jurisdiction.
7. Severability
If any part of this Protocol is deemed illegal or invalid, the invalidity of the clause will not affect the validity of the remaining provisions, provided that the invalid clause does not form the basis of the Protocol. The remaining provisions will remain binding and enforceable for the Parties.
8. Waiver
The failure or delay of any Party to exercise any right, power, or privilege under this Protocol will not be considered a waiver of such right, power, or privilege. Similarly, partial or individual exercise of any right will not preclude further exercise of any other right, power, or privilege. Any waiver of rights in the event of a breach of this Protocol will not constitute permission for repeated violations, nor will it imply a waiver of the right to exercise such privileges in the future.
9. Assignment
The User may not transfer or assign their rights and obligations under this Protocol to any third party without the prior consent of the Developer. Any such assignment will not relieve the User of their confidentiality obligations under this Protocol.
10. Notifications
Any notice, notification, or communication to the Developer shall be made via the email address iletisim@multiplayer.com.tr, whereas any notice to the User will be sent to the email address provided by the User during registration. The accuracy of the email address provided by the User is solely the responsibility of the User, and any notification sent to this address will be deemed duly delivered 72 hours after being sent.
